Current State: Settlement
A judge in the United States District Court for the Northern District of Illinois has preliminarily approved a class action settlement in the matter of Petrus v. Koppers Inc., (Case No. 1:24-cv-06872)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a settlement fund of $625,000 for members of the Certified Class, which is defined as follows:
All persons who have owned, rented or leased any residential property located in whole or in part within one (1) mile from the Koppers Facility located at 3900 S. Laramie Ave, Cicero, Illinois 60804, at any time between August 6th, 2019 to September 22nd, 2026.
The facility has announced that it will be widing down operations. The lawsuit alleged that odorous emissions from the Koppers Facility invaded residential properties and public spaces.
There are several Court-ordered deadlines that must be followed by members of the class:
- Claim Forms must be postmarked on or before Monday, December 7, 2026, in order to receive compensation from the Settlement Fund.
- Opt Outs and Objections must be postmarked on or before Saturday, November 21st, 2026.
A final fairness hearing will be held Tuesday, January 19th, 2027, at 11:00am at the United States District Court for the Northern District of Illinois Eastern Division, 219 South Dearborn Street, Chicago, Illinois, 60604.
